Terms of Service.
Last updated: May 2026. These terms govern your use of all Roost Hosting services including VPS hosting, shared hosting, domain registration, Roost AI, and the MCP server. Please read them before creating an account.
1. Agreement and parties
By creating an account or using any Roost Hosting service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use our services. These Terms form a binding legal agreement between you ("Customer", "you") and Roost Hosting LLC, a limited liability company registered in the State of Wyoming, USA ("Roost Hosting", "we", "us", "our").
Where you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
2. Services
Roost Hosting provides the following services under these Terms:
- VPS Hosting: KVM-based virtual private servers with hourly credit billing, full root access, NVMe SSD storage, monitoring agent, snapshots, and backups.
- Shared Hosting: cPanel-based shared web hosting billed on monthly or annual cycles, with SSO login from the Roost Hosting panel.
- Domain Registration: Domain registration, transfer, and management services across 400+ TLDs, provided as a registrar reseller.
- Roost AI: A panel-integrated AI assistant powered by Anthropic's Claude API that reads hosting context and responds to natural language queries. See section 8.
- MCP Server: A Model Context Protocol server that allows authorised external AI clients to access your hosting account data via bearer token. See section 9.
We reserve the right to modify, suspend, or discontinue any service with 30 days' notice, except in cases of emergency, security incident, abuse, or third-party provider failure beyond our control.
3. Account
- You must provide accurate and complete registration information and keep it current.
- You are responsible for all activity conducted under your account, including activity by anyone you grant access to.
- You must notify us immediately at support@roosthosting.com of any unauthorised use of your account.
- One account per person or organisation. Sub-accounts and reseller arrangements require our written consent.
- Users must be at least 18 years of age. By creating an account you confirm you meet this requirement.
4. Payment and credit
- VPS services use a prepaid credit balance. Billing is hourly, deducted from your balance each hour. The panel displays your available balance (spendable) and reserved balance (locked to cover active hourly services' next 24 hours) at all times.
- Shared hosting and domain registrations are billed on a recurring monthly or annual cycle via the payment method on file.
- All prices are in USD unless otherwise stated. Prices displayed in other currencies are estimates and subject to exchange rate fluctuation.
- If your credit balance is depleted below the reserve threshold, VPS services will be suspended. Services suspended for non-payment for more than 14 consecutive days may be permanently terminated and data deleted.
- Auto top-up, if enabled, is capped at 3 charges per calendar day as a circuit breaker against runaway billing. You can modify or disable auto top-up at any time.
- Refunds: Prepaid credit is non-refundable except where required by applicable law or at our sole discretion. Unused days on monthly/annual plans are non-refundable after provisioning, except within 7 days of first purchase. Hourly VPS charges are non-refundable once the billing hour has elapsed.
- We reserve the right to change pricing with 30 days' written notice to registered account holders. Continued use after the effective date constitutes acceptance of new pricing.
5. Acceptable use
You may not use our Services to:
- Violate any applicable local, national, or international law or regulation
- Send unsolicited bulk email (spam), conduct phishing campaigns, or engage in email-based abuse
- Host, distribute, or propagate malware, ransomware, spyware, botnets, or other malicious software
- Conduct or facilitate distributed denial-of-service (DDoS) attacks, port scanning, or network intrusion against any third party
- Host or distribute child sexual abuse material (CSAM) — violations result in immediate account termination and mandatory reporting to NCMEC and relevant law enforcement
- Infringe the intellectual property rights of any third party
- Mine cryptocurrency on shared hosting plans
- Exceed shared hosting resource limits in a way that materially degrades service quality for other customers
- Use the Roost AI assistant or MCP server to attempt to access data belonging to other customers, probe our infrastructure, or exfiltrate data beyond your own account scope
VPS hosting may be used for resource-intensive applications within your provisioned plan limits. Resource use that impacts shared infrastructure may result in suspension with prior notice where practicable.
6. Domains
- Domain registrations are subject to the policies of ICANN, the relevant registry, and our registrar partner.
- We act as a registrar reseller. Your domain registration creates a contractual relationship between you and the registry, mediated by Roost Hosting and our upstream registrar.
- WHOIS privacy is provided free of charge. It does not override lawful disclosure requirements from registries, ICANN, or law enforcement.
- You are responsible for maintaining accurate WHOIS contact information as required by registry and ICANN policy.
- Expired domains enter a grace period (typically 30 days at standard pricing, followed by up to 30 days at redemption pricing set by the registry) before becoming available to the public. We send expiry warnings at 30, 14, 3, and 0 days. Recovery is not guaranteed after the grace period.
- Outbound transfers: we will release an auth/EPP code promptly on request. We do not impose any lock-in or delay transfer-out beyond the standard 60-day post-registration lock required by ICANN policy.
7. Service levels and uptime
We target 99.9% monthly uptime for VPS and shared hosting infrastructure, measured excluding scheduled maintenance (announced 48 hours in advance via status page and email) and events outside our reasonable control (force majeure, upstream provider failures, DDoS attacks exceeding mitigation capacity).
Service credits: For verified downtime that causes monthly uptime to fall below 99.9%, we will credit your account at the rate of one day's equivalent service value per full hour of excess downtime, up to a maximum of one month's service value. Credits apply to account balance; they are not refunded as cash. Service credits are your sole remedy for service downtime.
To claim a credit, submit a support ticket within 14 days of the incident with the affected service and approximate downtime window.
8. Roost AI — AI assistant terms
Roost AI is an AI assistant integrated into the hosting panel. By using Roost AI, you agree to the following:
- No accuracy guarantee: AI responses are generated by a language model and may contain errors, omissions, or outdated information. All AI suggestions — including commands, configurations, and diagnoses — should be reviewed by a qualified human before execution. Roost Hosting is not liable for consequences of acting on AI output without verification.
- Shared inference key: If you use the default shared Anthropic key provided by Roost Hosting, your queries are processed by Anthropic's Claude API under our API agreement and Anthropic's usage policies. You agree to comply with Anthropic's Acceptable Use Policy.
- Bring Your Own Key (BYOK): If you supply your own Anthropic API key, you are solely responsible for usage costs incurred, compliance with Anthropic's API Terms of Service, and any data transmitted to Anthropic under your key. Roost Hosting is not a party to your agreement with Anthropic.
- Sensitive data: Do not input passwords, private keys, government-issued ID numbers, payment card numbers, or health information into the AI chat. This data would be transmitted to the inference provider.
- Read-only default: The AI assistant does not execute commands or make changes to your infrastructure without your explicit confirmation. Any action requiring a write operation will be surfaced for your approval before execution. This is a design guarantee, not a technical hard limit — exercise judgement.
- Session scope: AI conversations are scoped to your browser session. We do not store conversation history server-side beyond what is described in our Privacy Policy.
9. MCP server — infrastructure access via token
The Roost MCP server allows authorised external AI clients (such as Claude Desktop, Cursor, VS Code, or other MCP-compatible tools) to query your hosting account data using a bearer token.
- Token security: MCP tokens grant programmatic read (and optionally write, where enabled) access to your account. Treat tokens as passwords. Do not commit them to version control, post them publicly, or include them in screenshots.
- Token scope: MCP tokens expose: your service list, service status, resource metrics, recent log lines, domain list, and account credit balance. Payment instrument details and account credentials are never exposed via the MCP interface.
- Token revocation: You may revoke any MCP token at any time from Profile → AI Keys. Revoked tokens are invalidated immediately. We recommend rotating tokens periodically and after any suspected compromise.
- Third-party clients: When you connect Claude Desktop, Cursor, or another MCP client, data returned by our MCP server is handled by that client application under its own terms and privacy policy. Roost Hosting has no control over and is not responsible for how third-party MCP clients store, process, or transmit data received via the MCP interface.
- Your responsibility: You are responsible for ensuring that any third-party MCP client you connect is from a trusted source and is used in compliance with its own terms of service.
- Write access: MCP write capabilities (creating, restarting, or deleting services) require explicit opt-in when generating the token and are disabled by default. You are solely responsible for any infrastructure changes made via MCP write actions.
10. Data and backups
We provide daily backups for shared hosting included in the plan. VPS backups are available as an optional add-on managed via the panel. Even where backup services are provided:
- You are solely responsible for maintaining your own independent backups of critical data.
- We do not guarantee backup completeness, integrity, or restorability.
- Do not rely solely on Roost Hosting backups for mission-critical data recovery.
11. Intellectual property
Roost Hosting retains all intellectual property rights in the panel software, marketing website, and related documentation. Nothing in these Terms grants you a licence to Roost Hosting's intellectual property beyond what is necessary to use the Services.
You retain ownership of all content, code, and data you deploy on or through our Services. By using our Services you grant us a limited licence to process your data solely as necessary to deliver the Services.
12. Termination
We may suspend or terminate your account immediately without notice if you violate section 5 (Acceptable Use), particularly for CSAM, DDoS, malware distribution, or abuse of the AI/MCP features. For other violations, we will provide reasonable notice and an opportunity to remedy where practicable.
You may cancel your account at any time from the client panel. Cancellation stops future recurring billing. Hourly VPS services remain active until your credit balance is depleted or you manually destroy the instances. Monthly/annual services remain active until the end of the current paid period.
Upon account closure, your data will be deleted per our Privacy Policy retention schedule.
13. Liability limitation
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROOST HOSTING'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO ROOST HOSTING IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
IN NO EVENT SHALL ROOST HOSTING BE LIABLE FOR: LOSS OF DATA; LOSS OF PROFITS OR REVENUE; BUSINESS INTERRUPTION; LOSS OF GOODWILL; INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES; OR ANY LOSS ARISING FROM RELIANCE ON AI-GENERATED OUTPUT, REGARDLESS OF WHETHER ROOST HOSTING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Roost Hosting LLC and its members, officers, employees, and agents from any claims, damages, losses, costs, and legal fees (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use of the Services; (c) your Customer Content; or (d) your violation of any applicable law or third-party rights.
15. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
Dispute resolution: Disputes arising from or relating to these Terms or the Services will first be subject to good-faith negotiation. Either party may initiate this by sending written notice to the other. If the dispute is not resolved within 30 days of the notice, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with proceedings conducted in English. The arbitration shall take place in Wyoming, USA. Judgement on the arbitration award may be entered in any court of competent jurisdiction.
Class action waiver: All claims must be brought in an individual capacity. You waive any right to bring claims as a class action or in a class-wide, representative, or consolidated proceeding.
Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.
16. Changes to these Terms
We may update these Terms. We will notify registered users via email at least 14 days before material changes take effect. The current version is always available at roosthosting.com/terms. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
